Rules and Regulations

The Subscribe and Win Contest (the “contest”) begins at 12:01 a.m. EST on June 10, 2019 and closes at 11:59:59 p.m. EST on December 31, 2019 (“Contest Closing Date”). Please read the full contest rules and regulations, below.
This contest is open to all members in the following groups:
Active members of the Alberta Retired Teachers’ Association (“ARTA”)
Active members of the Alberta education community (“Active Educators”)
Active members of Suncor Employee Recreation Society (“SERA”)
Active members of Wood Buffalo Recreation Society (“WBRS”)
Active members of the Association of Administrative Professionals (“AAP”)
Full-time and part-time, active employees of the following groups (“Other Group Insurance Members”), specifically:
WestJet, an Alberta Partnership, including WestJet Encore Ltd. and WestJet Vacations Inc. (“Westjet”)
Deloitte LLP (“Deloitte”)
The Manufacturers Life Insurance Company (“Manulife”)
Workers’ Compensation Board - Alberta (“WCB”)
Syncrude Club 63 (“Syncrude”)
Alberta Oil and Gas Industry Professionals
All contestants must be a resident of Canada and of legal age in their resident province or territory. Quebec residents are excluded from this contest. Employees, directors, trustees and officers of TW Insurance Brokers Inc. (“TW”) and their affiliated companies 1, (collectively for purposes of this contest, “TW”), the prize selection team and members of their respective immediate families and/or anyone with whom the employees, directors, trustees or officers of TW are domiciled, are also excluded.
How to Enter – Online
Enter the contest at www.twinsurance.ca/subscribetowin. Contestants must provide their first and last name, valid email address, the name of the group which they are a member, and, must agree to either receive TW promotional emails and/or subscribe to a free subscription of the electronic TW Newsletter (delivered by email) (“mandatory information”) by checking the appropriate box on the contest entry form before they can be automatically entered into the contest and be eligible to win the prize. Failure to complete the mandatory information means the contestant will not be entered into the contest.
A maximum of one entry per contestant is allowed into the contest throughout the Contest Period. (Contest can only be entered once.) Multiple entries into this contest will not increase the contestant’s chances into the contest will be considered duplicate entries to the contest, declared void and the contestant will be disqualified from the contest rendering them ineligible for the prize.
Entries must be received on or before 11:59:59 p.m. EST on the Contest Closing Date. In disputes, online entries to the contest may be deemed to be made by the authorized account holder of the email address submitted at the time of entry. Authorized account holder is deemed as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address.
If anyone does not wish to receive marketing materials, promotional emails, electronic publications, including the TW Newsletter, product information, news, information and/or surveys by email and/or feedback emails after consenting to do so and/or after entering the contest, may unsubscribe at any time by selecting the unsubscribe link in the email delivering that particular promotional email sent by TW or by notifying TW’s Marketing Department at 1-866-272-5688.
Winner Selection / Draw
One separate and random draw will be made for the $1,000 prize after the Contest Closing Date from all eligible entries submitted into the contest up to and including, the Contest Closing Date. The separate and random draw will take place in Waterloo, Ontario on or about January 7, 2020 by an independent selection team.
Odds of winning are dependent on the number of eligible entries received by TW from across Canada by the Contest Closing Date. All decisions by the independent prize selection team are final and binding on the participants in all matters relating to the contest.
To win the prize the selected contestant must first correctly answer, without assistance of any kind, a time-limited, mathematical, skill-testing question in writing before being declared a prize winner.
For the purpose of these rules, the contestant is the person whose name was entered into the contest. In the event that more than one person is registered on the winning entry, all such persons will be jointly declared winners of the prize. They will then have to decide which one of them will answer the skill-testing question and receive the prize. In case of a disagreement between them, TW reserves the right to decide to which person the skill-testing question will be asked and the person to receive the prize if all other eligibility requirements are met.
The selected contestant will be notified by email using the email address entered into the contest. If the selected contestant cannot be contacted or does not respond after a minimum of three attempts within seven calendar days from the first attempt at contact, or if a prize notification notice is returned as undeliverable, or if the contestant incorrectly answers the skill-testing question, declines the prize or fails to return a release of liability to TW within 10 days’ time after receiving the same, that contestant will be declared ineligible to win the prize and another contestant will be selected in the manner described above.
When a contestant is contacted as the selected winner for a prize, he or she will be asked for an email address and/or a residential address to where the skill-testing question, a declaration of compliance with contest rules, a liability and publicity release can be sent.
Post office box addresses are not acceptable as courier companies cannot deliver to box numbers. If the winner resides at a country address and/or a rural route address, the winner may be asked for their emergency-locate address or other identifiable information to assist the courier company with the delivery of the prize.
The prize of the $1,000 cheque will be delivered to the declared winner by courier. Please allow ten business days for delivery of the prize save and except for any unforeseen events such as, but not limited to, a weather event, postal or courier strike, flood, fire, war, break out of disease, quarantine, hydro outage, service provider problems.
The one thousand dollar ($1,000) prize awarded will be by cheque in Canadian funds payable to the winner and is non-transferable and non-exchangeable for cash or any other form except at the discretion of TW. The cheque will not be made payable to any other party other than the declared winner. The prize cheque must be cashed by the winner within six months from the date on the cheque (not from the date the cheque is received). After the six months have expired, the cheque will be considered stale-dated by the bank and the prize will be considered void. A replacement cheque for the prize may not be granted. Any winner who attempts to cash the prize cheque after the six months has expired from the date on the cheque will be responsible for, but not limited to, any bank fees, interest charges, penalties levied by the bank and the like if the cheque is returned by the bank for any reason. The winner is responsible for all their own bank fees.
TW will not be responsible for a lost, stolen, or misplaced prize/cheque or for any fees or charges associated with cashing the cheque. The prize (cheque) will not be replaced, refunded or reimbursed if lost, stolen or misplaced. The prize is non-transferable, non-assignable and non-exchangeable for cash or any other form except at the discretion of TW.
Personal information will not be shared with parties outside of this contest.
It is the sole responsibility of any contestant to notify TW’s marketing department of any changes to their contact information by calling 1-800-267-6847 or in writing by emailing firstname.lastname@example.org or by sending a note to: TW Insurance Brokers, c/o Marketing Dept., P.O. Box 218, 125 Northfield Drive West, Waterloo, ON N2J 3Z9, if they still wish to be entered into the contest.
Entries and the prize claim are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

This contest is subject to all applicable Canadian federal, provincial, territorial and municipal laws and regulations, is void where prohibited by law and is governed by Canadian laws and the laws of the Province of Ontario. If any provision of these rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
By participating in this contest, contestants agree to be bound by these rules and regulations.
TW will not be held responsible for any errors or negligence that may arise or occur in connection with the contest including, but not limited to, the contestant’s information entered into the contest page and the contest by any person, including, but not limited to, a customer sales representative.
The contestants are responsible for ensuring they read and understand any rules, regulations and terms and conditions of this contest. TW is not responsible for any failure to read and understand these rules, regulations and terms and conditions.
Any and all taxes on the prize awarded, including income taxes, and any incidental expenses associated with collection of the prize, are the sole responsibility of the winner. No substitutions will be made for the prize except at the discretion of TW who may substitute a prize of equal value in the event the contest prize is no longer available. All Internet fees, transactional fees, down-loading fees, up-loading fees, accessories, application fees (App fees), Wi-Fi costs, roaming charges, costs of programs, long distance charges, travel expenses, mileage, accommodations, meals and extraordinary expenses, including but not limited to beverages and any feature and accessory not expressly listed as part of the prize shall be the sole financial responsibility of the prize winner. None of the contestants and/or the prize winner will be eligible to seek reimbursement for the same from TW, its affiliates or representatives or any other party to this contest.
The prize shall be null and void if the declared winner does not accept their prize by June 30, 2020.
TW reserves the right to withdraw, terminate, suspend, cancel, amend or modify all or part of the contest, in any manner and any rule(s) of the contest, including the number of prizes awarded and/or their amount, at any time and without prior notice, for any reason whatsoever or if it determines that for any reason the contest cannot be run as originally planned, including, but not limited to, technical failure or corruption, computer virus, bugs, computer, electronic or system malfunction, tampering, unauthorized intervention, fraud or any other factor(s) or cause(s) beyond TW’s control which in TW’s opinion compromises the fairness or integrity of the contest and/or affects the administration, security, or proper conduct of this contest as contemplated by these official rules. Failure to comply with TW’s terms and conditions may disqualify the selected contestant and/or winner from receiving the prize.
If, as a result of an error relating to the entry process, entry, entry count, drawing or any other aspect of the contest, there are more potential winners of the prize than contemplated in these rules, there will be a random draw amongst all eligible prize claimants after the Contest Closing Date to award the prize.
By submitting a completed entry form to enter the contest, the winner releases TW from any and all liability arising out of, or in connection with, this contest and the awarding of any prize, now or in the future. By entering this contest, the winner consents in writing to the use of their name, city and province/territory where they reside and group associated with by TW in a format approved by that winner, as well as any audio/video image, statements, and/or photographs in any related publicity and publication without further compensation, worldwide and in perpetuity, in any and all forms of media and social media now known or hereafter devised, including, but not limited to, the Internet, Facebook, Twitter, Linked In, You Tube, Pinterest, SnapChat and in any publicity or advertising carried out by TW, unless prohibited by law. TW reserves the right to post or publish any winner’s name, city, or province/territory of residence, photograph, likeness, voice or other statements, as directed by the winner, on its website and/or on the website of TW’s affiliated companies for advertising and promotional purposes, where lawful, without further compensation to the winner, worldwide and in perpetuity.
By entering in the contest, the winner agrees to sign a form of declaration confirming compliance with the contest rules and regulations and agrees to release, indemnify and forever discharge TW and its affiliated companies, directors, trustees, officers, employees, the prize selection team and any of their parents, affiliates, agents, and contractors, from any and all action, proceedings, suits, liability, losses, costs, expenses (including legal fees and disbursements), damages, demands and claims of any kind, in respect of anything done by TW in the performance of their duties hereunder in connection with the contest and/or resulting from the acceptance, possession or use of a prize or any part of a prize or any extension to a prize, including without limitation, but not limiting to, any loss, personal injury, death, disablement, dismemberment, property, home or auto damage, or claims based on publicity rights, defamation or invasion of privacy that could result from, but not limited to, the awarding or use of any prize, by signing an Agreement / Release Form as a condition to and in advance of receiving their prize in favour of TW and TW will not be liable for the use or misuse of the prize or any purchases made with the prize. TW assumes no responsibility for the participation in the contest or any liability, claims, demands, actions, loss, damage or personal injury that may be sustained by the contestants and/or the winner. The provisions of this section shall survive the termination of this contest and may be relied upon by the parties hereto at any time.
Failure to comply with these contest rules and regulations may result in disqualification from the contest at any time.
TW is not responsible for any entries that are lost, late, damaged, destroyed, corrupted or misdirected, incomplete, garbled, or delayed by or on any computer, online telephone or technical malfunctions that may occur in the processing transmission or receipt of entries.
TW is not responsible for any theft, destruction or unauthorized access to, or alteration of, entries; failures or malfunctions of electronic data transmission, telephones, telephone lines or telephone systems, interrupted or unavailable network, server or other connections, any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to the participant’s or any other person’s computer related to or resulting from participation in this contest; the cancellation, suspension or preemption of games, injuries or timing errors, electronic or equipment failure or other communication problems occurring in connection with participation in this contest nor is it responsible for any transmission of viruses from any TW website to a computer system or if any whole entry system crashes resulting in the contest being cancelled or other problems or errors of any kind whether mechanical, human, electronic or otherwise.
TW and the prize selection team and any of their parents, affiliates, agents, and contractors, including advertising, sponsoring and promotional agencies, and their directors, trustees, officers and employees expressly disclaim and shall be held free of all responsibility or liability for any loss or damage in respect to any prize howsoever caused, any act, error, omission, injury, loss, accident, delay or the neglect or default of any company or person providing any service for the contest, whether through providers negligence or otherwise, or due to cancellations, adverse weather conditions, loss of personal belongings, illness, bodily injury, accident, death, deterioration of services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical due to any Acts of God, force majeure or third party wrong doing, epidemic, social or political disturbances or due to any cause whatsoever occurring during the contest and the use of the prize by the winner.

Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, TW (as defined above) reserves the right to seek damages from any such contestant to the fullest extent permitted by law.
